1 Acceptance of Terms

Welcome to Radstep. By downloading, installing, creating an account for, or using the Radstep mobile application ("App") or any related services available at radstep.com (collectively, the "Service"), you agree to be legally bound by these Terms of Service ("Terms").

If you do not agree to these Terms, do not download or use the App. Your continued use of the Service after any changes to these Terms constitutes acceptance of those changes.

You must be at least 13 years old to use Radstep. If you are under 18, your parent or legal guardian must read and agree to these Terms on your behalf. By using the Service, you represent that you meet this age requirement.

2 Description of Service

Radstep is a fitness and creature-collection application that reads your daily step count from your device's health platform to power gameplay and award in-app rewards based on your real-world movement.

Core Features

• Step-count tracking via Apple Health (iOS) and Health Connect (Android)
• Creature collection, hatching, breeding, and battling powered by your steps
• Experience points (XP), levels, streaks, and progression system
• In-app currency earned through activity and purchasable
• Social features including friends, guilds, goals, and leaderboards
• Optional premium subscription with enhanced rewards and features
• In-app shop for cosmetics and power-ups

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time. We will endeavor to provide advance notice of material changes where reasonably practicable.

3 User Accounts

Most features require a Radstep account. You may register with an email address and password, or via a supported third-party authentication provider (currently Google and Apple).

Your Responsibilities

• Provide accurate, current, and complete registration information
• Keep your account credentials secure and confidential
• Notify us immediately of any suspected unauthorized access at [email protected]
• Accept full responsibility for all activity that occurs under your account
• Maintain only one personal account (multiple accounts to exploit reward systems is prohibited)

Account Deletion

You may delete your account at any time via Settings → Delete Account in the App. Upon deletion, your personal data will be handled as described in our Privacy Policy. Active subscriptions must be cancelled separately through your app store.

4 Subscriptions & Billing

Radstep offers optional premium subscription plans that unlock additional features, bonus rewards, exclusive cosmetics, and other benefits. Current plans, pricing, and billing intervals are displayed in the App at the time of purchase.

Billing

• Subscriptions are billed automatically on a recurring basis (monthly or annually)
• Payment is processed by Apple (App Store) or Google (Play Store) depending on your platform
• Your subscription renews automatically unless cancelled at least 24 hours before the renewal date

Cancellation

Cancel any time through your app store account settings (Apple ID → Subscriptions or Google Play → Subscriptions). You retain premium access until the end of the current paid period. We do not offer partial-period refunds.

Refunds

Refund requests are handled exclusively by Apple and Google under their respective refund policies. Radstep does not process subscription refunds directly. For billing disputes, contact [email protected] and we will assist.

Price Changes

We may update subscription pricing. You will be notified before your next renewal. Continued subscription after the price change date constitutes your acceptance of the new price.

5 In-App Purchases

Radstep offers virtual Gold currency and cosmetic/functional items purchasable within the App. All in-app purchases are final and non-refundable except where required by applicable law or app store policy.

• Virtual Gold and items have no real-world cash value and cannot be exchanged for money
• Virtual items are licensed to you for use in the App; Radstep retains ownership
• Item functionality, availability, and pricing may change with App updates
• Unused virtual items and currency are forfeited if your account is terminated for violations of these Terms
• We are not responsible for virtual items lost due to your account deletion or termination

6 Fitness Data

Radstep's core functionality relies on your daily step count. With your permission, the App reads step data from Apple Health (iOS) or Health Connect (Android) to power gameplay such as hatching eggs, battling, and progressing your radmon. By granting step-count access, you consent to the collection and processing of this data as described in our Privacy Policy.

Step Count Access

Radstep reads only your step count and does not access your GPS location, routes, or precise whereabouts. You may revoke step-count access at any time in Apple Health, Health Connect, or your device settings, which will limit the App's functionality.

Health & Fitness Disclaimer

Radstep is designed for motivation and entertainment and is not a medical device. Fitness data shown in the App (such as steps) is estimated and should not be relied upon for medical or clinical purposes. Always consult a qualified healthcare provider before beginning a new exercise program. Radstep is not liable for any physical injury, illness, or health condition arising from activity tracked or encouraged by the App.

7 Acceptable Use

You agree not to use the Service to:

• Simulate activity using scripts, bots, step spoofing, cheat software, or any other artificial means
• Manipulate step counts or reward amounts to gain an unfair advantage
• Reverse-engineer, decompile, or attempt to extract the App's source code or algorithms
• Harass, threaten, bully, or discriminate against other users
• Post illegal, offensive, hateful, or sexually explicit content in social features
• Attempt to gain unauthorized access to Radstep's systems or other users' accounts
• Introduce malware, viruses, or disruptive code into the Service
• Create multiple accounts to circumvent suspensions or exploit referral/reward systems
• Violate any applicable local, national, or international law

Violations may result in immediate suspension or permanent termination of your account without refund of any subscription fees or virtual currency.

8 Intellectual Property

The Radstep App and all associated content — including logos, graphics, user interface design, software code, text, sounds, and animations — are owned by or licensed to Radstep and protected by copyright, trademark, and other applicable intellectual property laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the App for your personal, non-commercial purposes, subject to these Terms. You may not copy, modify, distribute, sell, create derivative works from, or sublicense any part of the App or its content without our prior written consent.

9 User-Generated Content

You may submit content through App features such as group names, profile customizations, challenge descriptions, or community posts ("User Content"). By submitting User Content, you grant Radstep a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute that content solely to operate and improve the Service.

You represent that you own or have the rights to all User Content you submit and that it does not violate any third-party rights. We may remove any User Content that violates these Terms or is otherwise objectionable, at our discretion and without notice.

10 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that: the Service will be uninterrupted, timely, or error-free; step or fitness data will be perfectly accurate; the Service will meet your requirements; or that any defects will be corrected. Your use of the Service is at your sole risk.

11 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RADSTEP AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR PERSONAL INJURY — ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS PAID BY YOU TO RADSTEP IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM OR (B) TWO HUNDRED POLISH ZŁOTY (200 PLN).

12 Indemnification

You agree to indemnify, defend, and hold harmless Radstep and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of or inability to use the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

13 Termination

Either party may terminate your use of the Service at any time. We may suspend or permanently terminate your account immediately, without prior notice or liability, for any violation of these Terms, suspected illegal activity, or any other reason at our discretion. Upon termination:

• Your license to use the App is immediately revoked
• Virtual items and Gold are forfeited (for policy violations)
• Any outstanding subscription fees remain owed for the current billing period
• Provisions that by their nature survive termination (disclaimers, liability limits, governing law) shall continue in effect

14 Governing Law & Disputes

These Terms and any disputes arising from them shall be governed by the laws of Poland, without regard to its conflict of law principles. You agree that any dispute with Radstep shall be resolved through binding individual arbitration rather than in court, except for claims that qualify for small claims court.

If mandatory arbitration is unenforceable in your jurisdiction, the exclusive forum for any legal proceedings shall be the courts located in Poland, and you consent to personal jurisdiction there.

Class action waiver: To the extent permitted by law, you waive the right to participate in any class action lawsuit or class-wide arbitration against Radstep.

15 Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will post a notice in the App and update the "Last updated" date at the top of this page. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
